The General Terms and Conditions of the Musicguards.com online shop are drawn up in accordance with the Consumer Protection Act (ZVPot), the Personal Data Protection Act (ZVOP-1) and the Electronic Communications Act (ZEKom-1).

The Musicguards.com online shop is operated by the company Musical School Bučar, s.p., Dolgo Brdo 10, 1129 Ljubljana Zalog

The General Terms and Conditions of Business govern the operation of the Musicguards.com online shop, the rights and obligations of the user and the shop, and the business relationship between the customer and Musicguards.com.

The Buyer shall be bound by the General Terms and Conditions in force at the time of placing the online order, i.e. purchase. When placing an order, the user is always specifically reminded of the General Terms and Conditions and confirms that he/she is aware of them by placing the order. The General Terms and Conditions are available on all pages at the bottom of the Musicguards.com online shop.

Placing an order

Orders can be placed 7 days a week, 24 hours a day.

The contents of your order can be edited in the shopping basket. You can change the quantity in your basket, or delete products from it. If you are sure that you want to buy the products in your shopping basket, click “place an order”. For communication purposes, please check the accuracy of the delivery address and your telephone number. Confirm your purchase by clicking on “confirm order”. You will receive a confirmation of your order at the email address you entered.

Payment methods

Payment on Musicguards.com is possible in the following ways:

  • as per advance invoice (countries: Slovenia),
  • Cash on delivery (countries: Slovenia),
  • by debit or credit card (countries: Slovenia, Austria, Germany).

Delivery of items

Goods ordered are dispatched 1-2 days after payment is visible or, in the case of cash on delivery, after the order has been placed.

Delivery methods and costs depend on the address where the goods are ordered and the items selected.

Delivery time depends on the delivery address and the day the order is placed, but usually ranges from 3-8 days.

In no event shall we be liable for the delivery of the goods within the normal estimated delivery period as set out in the preceding paragraph. The deadline is for information only.

Invoicing

After payment of the ordered items, Musicguards sends an invoice in .pdf format to the customer’s e-mail address. The buyer receives an invoice for each separate order.

The invoice itemises the price and all costs related to the purchase, and gives notice of the right of withdrawal.

It is the Buyer’s responsibility to verify the accuracy of the information before placing an order. We will not take into account any subsequent objections to the correctness of the invoices.

Return of products

The Buyer has the right to notify the Seller within 14 days of taking delivery of the Goods that it cancels the contract without having to give a reason for its decision. The time limit starts one day after the date of receipt of the goods.

The consumer shall notify the withdrawal from the contract to the Seller’s e-mail address: info@musicguards.com.

This applies exclusively to natural persons who acquire the item for purposes outside their own gainful activity.

Material defect

Consumers (i.e. a natural person who buys an item for purposes outside his/her trade or profession) from an EU or EEA Member State are entitled to the protection for material defects under this point.

The error is real when:

  • the product does not have the characteristics necessary for its normal use,
  • the product does not have the characteristics necessary for the specific use for which the buyer is buying it, which were known or should have been known to the seller,
  • the product does not have the characteristics and qualities that were agreed or specified,
  • the product handed over does not match the sample or model, unless the sample or model was shown for information only.

The conformity of the product is verified against other, faultless products of the same type, as well as against the manufacturer’s declarations or the claims made on the product itself.

You can exercise your rights under the material defect law if you notify us of the defect within two months of the date on which the defect was discovered. In the defect notification, you must describe the defect in detail and allow us to inspect the product.

We are not liable for material defects that become apparent after 2 years from the date of receipt of the product. A defect in the goods shall be deemed to have existed at the time of delivery if it occurs within six months of delivery.

If you have correctly notified us of a factual error, you have the right to request that:

  • fix a defect in the product, or,
  • refund a proportion of the amount paid in proportion to the defect, or,
  • we will replace the faulty item with a new, faultless one, or,
  • refund the amount paid.

If the existence of a defect in the product is not disputed, we will grant your request as soon as possible and within 8 days at the latest. However, if the existence of a defect in the product is disputed, we will respond to the request in writing and explain our position no later than eight days after receiving the request.

Protection of personal data

Limitation and exclusion of liability:

The accuracy and up-to-dateness of the information provided by the Buyer on the Website is the Buyer’s sole responsibility. Musicguards.com accepts no responsibility for any consequences that may arise as a result of inaccurate or incorrect information. In the event of damage caused by incorrect information, the Buyer shall be liable to pay compensation in accordance with the general rules on liability for damages.

We are also not responsible for the proper functioning of Stripe or other payment or data entry functions provided by third parties to the fullest extent permitted by law. Musicguards.com shall not be liable for any costs or damages incurred in connection therewith.

Musicguards.com accepts no liability to anyone other than the customer who placed the order in relation to the products and e-commerce services offered. He shall be liable to the Buyer only for direct damages which would have been caused by gross negligence or wilful misconduct. Liability for consequential or other damages, as well as for damages caused by third parties, is excluded.

Application of the law

The law of the Republic of Slovenia applies to the General Terms and Conditions, the Purchase Agreement and the relationship between the Buyer and Musicguards.com, except where EU law requires the application of various consumer law provisions of another country in addition to Slovenian law.

Complaints and dispute resolution

Musicguards.com complies with the applicable consumer protection legislation, does not recognise out-of-court consumer dispute resolution providers as competent to resolve a consumer dispute that you, as a customer, may have under the Act on Out-of-Court Settlement of Consumer Disputes (OCCS).
